  • On 1 April 2008, Broad & Bright was awarded "Asia-Pacific Trademark 2008 Award" by Managing IP, a highly esteemed magazine in the intellectual property arena, for our excellent performance and incredible success in representing Yamaha Motor Co., Ltd. in a trademark infringement lawsuit. Managing IP commented: Broad & Bright Law Firm helped Yamaha win the largest damages ever awarded to a foreign company for trade mark infringement in China last year. But apart from the size of the Rmb8.3million ($1.1million) award the decision was a breakthrough in two areas. First, in calculating the damages, the judge took into account the evidence submitted by Yamaha but ignored the financial information provided by an auditor’s report claiming that Zhejiang Huatian had made no money from the infringement. Second, the judge made two distributors, Taizhou Jiaji and Taizhou Huatian, jointly and severally liable for paying the damages.     [More...]
